Microsoft makes Windows Phone commercial, sells iPhone instead

Microsoft has released a new commercial for the Windows Phone Nokia Lumia 920, and in it they show off both Apple's iPhone 5 and Samsung's Galaxy S. A lot. So much, in fact, it's hard to know what the commercial is about until the very end, when the Lumia 920 finally makes an appearance. Anyone outside Microsoft see the problem there?

The theme is: Don't fight. Switch. The setting is a wedding where the groom and the bride's side both use different phone platforms, and quickly get into a heated, and pretty funny war of insults that escalates into full-blown Mobile Kombat. When nothing but dust and decimation remains, the waiters wonder if Lumia couldn't just help them all get along.

Here's what Microsoft's Michael Stroh had to say on the Windows Blog:

I chuckled when I first saw the spot. As you?ll see, it plays off the strong?even irrationally strong?feelings some of us harbor about the technology in our purses and pockets. You might recognize someone you?ve met among the wedding guests. You might see shades of yourself. I sure did?and smiled.

I did as well. And it wouldn't be out of place on a late night comedy show. Actually, it would kill as comedy. But this isn't comedy, it's the real, brutal, smartphone market, and here is that Microsoft is promoting Apple and Samsung over their own brands, and that's exactly what happens to them in the market already. Apple had a "switcher" campaign for the Mac many years ago, and while they had a generic "PC" character, he was seldom if ever branded, and there certainly wasn't ever any recognizable, competing hardware in the frame.

Ultimately, however, I didn't really end up caring any more about Windows Phone than I did at the beginning, and that makes it a pretty ineffective commercial. Give it a watch and tell me what you think. Anything there that's better than, I don't know, say Microsoft actually releasing an XPhone Halo edition?

PSA: T-Mobile's Samsung Galaxy S 4 available online today

PSA TMobile's Samsung Galaxy S 4 available online today

Samsung's latest flagship, the GS4, landed on Sprint and AT&T a couple of days ago, and now it's T-Mobile's turn to join the party -- at least by way of its virtual stores. Taking advantage of the carrier's recently unveiled pricing scheme, the Galaxy S 4 will be available starting at $149.99 up front for the 16GB model (plus the $20 extra per month for the next two years, of course). Now, if you're looking to physically pick one up instead, you'll have to wait a little longer, as it won't be available at brick-and-mortar shops until May 1st.

Twitter Is Testing Out Its Official Google Glass App In The Wild

6976760106_3f0e3a206a_zIt’s only a matter of time before Twitter releases its own Google Glass app, as Kleiner Perkins’ John Doerr dropped the hint that the company was looking into building one during this month’s Glass Collective announcement. A tweet from an official Twitter Glass app has been spotted, interestingly enough by the gentleman who brought you the first unofficial Twitter app, GlassTweet. The user that it came from had no information in their bio when I looked at the profile, but it has since been deleted, along with the tweet below: You’ll notice the “Twitter for Glass” label, which denotes which app the tweet came from. That, coupled with the fact that the account has since been deleted, shows that somebody might have let the cat, or Glass, out of the bag a little too early. I reached out to Twitter, but the company provided us with no statement or comment on its intentions for Glass. It will be interesting to see what an actual Twitter Glass experience will be, as I can’t imagine that anyone would want to see every single tweet from their stream pass before their eye. I could see the utility of getting direct messages, perhaps replies and mentions and most certainly sharing pics and videos. Expect to see a lot of Glass apps popping up from companies like Twitter and Facebook in the next few months, as the companies are trying to figure out how best to tap into a device that could increase usage and let users share a brand new perspective with media. The example that I always use with people is that Glass will be really fun at a concert or other live event, where I don’t have to take a phone out of my pocket and remove myself from the situation. It will be natural to snap a shot without disrupting my field of vision and attention. [Photo credit: Flickr]

Sprint's Samsung Galaxy S4 getting its first OTA update today

Galaxy S4

24MB over the air update rolling out now for Sprint's newest smart phone

If you were lucky enough to pick up a Sprint Galaxy S4 over the weekend, you'll want to start checking for a system update. Build L720VPUAMDL is pushing out, checking in at about 24MB. A scouring of the Internet doesn't seem to tell us anything about this update or what it addresses, so your guess is as good as ours. We assume it's a standard last-minute patch that we see with many new devices, and won't bring any new functionality or make any big changes.

In any case, you'll probably want it so be sure to check Settings > More > System Update to update the Samsung firmware.

Thanks, Manuel!

Sony Xperia SP on sale now in the UK at T-Mobile, Orange and EE

Sony Xperia SP on sale now in the UK at T-Mobile, Orange and EE

Sony's mash-up Xperia, the SP, is taking its transparent element light show to the UK today, giving budget-minded Brits one stylish and feature-packed handset. The 4.6-inch 720p handset, which is basically a Best of... edition of the Xperia S and P with an aluminum unibody, is shipping now at T-Mobile UK for £250 outright (about $387 USD), whereas Orange and EE are offering up the device for free with qualifying plans. If you want LTE, however, you only have one carrier option and that's EE -- a choice that'll have you shackled for a two-year period. As for O2 and Three, those carriers still have the SP listed as "coming soon," but it's safe to say you won't find a better bargain than *free.

Two bizarre endings mar UFC 159 prelims

The UFC debut of two Strikeforce light heavyweights was spoiled by a odd ending. Ovince St-Preux beat Gian Villante in a majority technical decision after the fight was stopped because of a poke to the eye.

After a back-and-forth, but not entirely thrilling bout, St-Preux threw a punch and accidentally poked Villante in the eye. Villante stepped back and crouched down, indicating to referee Kevin Mulhall that there was a problem with the eye. Mulhall asked Villante if he could see, and Villante said no, he couldn't see.

At that point, Mulhall waved his arms and the fight was stopped. Villante protested, but the fight was over. Because the round had started, it had to be judged. The scores were 30-28, 29-28 and 29-29 in St-Preux's favor.

?I couldn?t see. He did poke me in the eye so I don?t know," Villante said after the fight. "He said the fight was over and I didn?t expect that because I was just reacting to his question. I got poked and my eye was closed up so I thought he would stop it but he didn?t, he just kind of looked at me. I don?t understand how you score thirty seconds of a round and that?s how I lost? We were just getting going and I got poked in the eye. I don?t know what to say.?

Mulhall's stoppage adhered to the eyepoke rule, if not literally, then in spirit. When a fighter says he can't see, the fight is stopped. However, Mulhall could have used better communication and followed procedures. It would have been better if he explained to Villante that he didn't have time to recover and that the fight would be stopped if he said he couldn't see.

UFC 159's weird streak continued in the very next bout. Rustam Khabilov and Yancy Medeiros' fight was stopped halfway through the first round. Medeiros defended a Khabilov takedown attempt, but hit his hand awkwardly. His thumb ended up pointing a way thumbs are not supposed to point and the bout was stopped at 2:32 of the first round.

Two weird endings marred the preliminary card, but the UFC rarely lets a weird ending go. Quite often, these fights get a rematch, so don't be shocked if you see these fights happen again on a card this summer.

Egypt arrests 12 'Black Bloc' members at presidency | Morocco ...

CAIRO, April 27, 2013 (AFP)

Egyptian police arrested 12 members of the ?Black Bloc? ? a violent group opposed to the Muslim Brotherhood ? after clashes outside Cairo?s presidential palace, the official MENA news agency said Saturday.

Protesters hurled rocks and fire bombs at the walls of the presidential palace in Heliopolis, and torched a police vehicle, a security source told MENA.

?Security forces arrested 12 youths who were among rioters involved in the events around the presidential palace on Friday,? the source said, adding the judiciary would take action against those involved.

Police fired tear gas to disperse the masked activists of the Black Bloc movement, a security source told AFP.

Footage broadcast on private television station ONTV showed a police vehicle ablaze on the edges of the presidential palace compound.

State television reported early Saturday that ?clashes between the police and the Black Bloc at the presidential palace wounded 20 people.?

A security official told AFP that three security personnel, including two officers, were among those hurt.

Demonstrators, hooded and masked and dressed in black from head to toe, appeared in January in Cairo and other provinces, calling themselves the Black Bloc.

They present themselves as the defenders of protesters opposed to Islamist President Mohamed Mursi?s rule.

On their Facebook page, the activists say they are a ?generation born of the blood of the martyrs? from the 2011 revolution that toppled former president Hosni Mubarak.

Prosecutor general Talaat Abdallah accused the group of ?terrorism? three months ago.

For the past five months, Egypt has been suffering a grave political crisis, marked by deadly clashes between supporters and opponents of Mursi.

The palace in Heliopolis has already been the scene of similar violence, notably in December, when tens of pro- and anti-Mursi demonstrators died in clashes.

Obama pokes fun at himself at White House Correspondents' Dinner

WASHINGTON (AP) ? President Barack Obama joked Saturday about his plans for a radical second-term evolution from a "strapping young Muslim Socialist" to retiree golfer, all with a new hairstyle like first lady Michelle's.

Obama used this year's annual White House Correspondents' Association dinner to poke fun at himself and some of his political adversaries, asking if it was still possible to be brought down a peg after 4? years as commander-in-chief.

Entering to the rap track "All I Do Is Win" by DJ Khaled, Obama joked about how re-election would allow him to unleash a radical agenda. But then he showed a picture of himself golfing on a mock magazine cover of "Senior Leisure."

"I'm not the strapping young Muslim Socialist that I used to be," the president remarked, and then recounted his recent 2-for-22 basketball shooting performance at the White House Easter Egg hunt.

But Obama's most dramatic shift for the next four years appeared to be aesthetic. He presented a montage of shots featuring him with bangs similar to those sometimes sported by his wife.

Obama closed by noting the nation's recent tragedies in Massachusetts and Texas, praising Americans of all stripes from first responders to local journalists for serving the public good.

Saturday night's banquet not far from the White House attracted the usual assortment of stars from Hollywood and beyond. Actors Kevin Spacey, Julia Louis-Dreyfus and Claire Danes, who play government characters on series, were among the attendees, as was Korean entertainer Psy. Several Cabinet members, governors and members of Congress were present.

And despite coming at a somber time, nearly two weeks after the deadly Boston Marathon bombing and 10 days after a devastating fertilizer plant explosion in West, Texas, the president and political allies and rivals alike took the opportunity to enjoy some humor. Late-night talk-show host Conan O'Brien headlined the event.

Some of Obama's jokes came at his Republican rivals' expense. He asked that the GOP's minority outreach begin with him as a "trial run" and said he'd take his recent charm offensive with Republicans on the road, including to a book-burning event with Rep. Michele Bachmann.

Casino magnate Sheldon Adelson would have had better success getting Obama out of office if he simply offered the president $100 million to drop out of last year's race, Obama quipped.

And on the 2016 election, the president noted in self-referential irony that potential Republican candidate Sen. Marco Rubio wasn't qualified because he hasn't even served a full term in the Senate. Obama served less than four years of his six-year Senate term before he was elected president in 2008.

The gala also was an opportunity for six journalists, including Associated Press White House Correspondent Julie Pace, to be honored for their coverage of the presidency and national issues.

The New Yorker's Ryan Lizza won the Aldo Beckman Award, which recognizes excellence in the coverage of the presidency.

Pace won the Merriman Smith Award for a print journalist for coverage on deadline.

ABC's Terry Moran was the winner of the broadcast Merriman Smith Award for deadline reporting.

Reporters Jim Morris, Chris Hamby and Ronnie Greene of the Center for Public Integrity won the Edgar A. Poe Award for coverage of issues of national significance.

The Different Types Of Tummy Tuck | Jackie's Women's Interest Bazaar

Related eBooks

A tummy tuck is technically know as abdominoplasty. It is a procedure used in cosmetic surgery in order to create a firmer abdomen, flatter stomach and a desirable body shape. It is often used by patients who have recently been pregnant or have sagging skin due to recent weight loss, but some people use it to get remove unwanted fat.

Unwanted fat and skin is removed from the lower and middle parts of the abdomen, which tightens up muscles in the abdominal wall. There are numerous types of abdominoplasty, the most appropriate type depends on the amount of fat and skin to be removed. The most common are partial and complete abdominoplasty procedure.

A partial abdominoplasty procedure will only take between one and two hours, whereas a complete abdominoplasty procedure will take between one and five hours, depending on the extent of the fat and skin removal.

Complete abdominoplasty procedures involve cutting from the right to left of the abdomen just above the pelvic area. Another cut is then made from the navel down to the area just above the groin. The skin is then separated and any excess is removed before liposuction is applied to remove fat if necessary; muscles are tightened using surgical stitching (sutures.)

A partial abdominoplasty procedure or mini tuck is a much less invasive surgery. A smaller incision is made and less skin is removed from the body; sutures are also used to tighten muscles. Liposuction may also be used to contour the stomach area.

There are other ways to carry out the surgery. Extended abdominoplasty will also lift the thighs in order to improve body shape. High lateral tension is very advanced but tightens up muscles in a horizontal direction as well as the usual vertical directions. This is particularly good for getting beautifully contoured body shapes.

Circumferential abdominoplasty includes the lifting of the buttocks and the incision is made all around the waistline. This procedure is very effective for people who have experienced a large amount of weight loss and have a lot of sagging and excess skin and muscle. There are also a number of combination procedures that include other parts of the body such as breast lifts, or breast reduction. There is risks involved in these procedure so it is very important to get professional advice before deciding on the surgery Have a look online for cosmetic surgeries that can provide a tummy tuck and request a thorough consultation.

TORONTO (Reuters) - Canada's main stock market finished lower on Friday as natural resource stocks slumped and market sentiment soured following U.S. economic growth data that fell short of expectations. U.S. gross domestic product expanded at a 2.5 percent rate, an increase from the fourth quarter's dismal 0.4 percent pace but shy of the 3 percent growth analysts were hoping for. The weaker-than-expected data in Canada's biggest trading partner weighed on Canadian stocks.

Vodafone investors want bigger bid or full takeover by Verizon

LONDON (Reuters) - Six major Vodafone investors said $100 billion was not enough for the British company's stake in its U.S. joint venture with Verizon Communications , and urged the latter to come up with an offer of at least $120 billion. Their comments followed a Reuters report on Wednesday that Verizon had hired advisers to prepare a possible $100 billion bid to buy Vodafone's 45 percent stake in their Verizon Wireless joint venture, likely to be structured as a roughly 50:50 cash and stock bid.

TransCanada sees Keystone XL delayed till second-half 2015

CALGARY, Alberta (Reuters) - TransCanada Corp , Canada's No. 2 pipeline company, said on Friday the long wait for U.S. government approval of its controversial Keystone XL project will further delay completion of the pipeline and push its cost above the company's $5.3 billion estimate. TransCanada, which reported a 27 percent rise in first-quarter profit on Friday, is waiting for the Obama administration to issue a presidential permit for construction of the line, which is designed to carry 830,000 barrels a day of Canadian and U.S. crude oil to refineries on the Gulf of Mexico coast.

U.S. sues Novartis over kickbacks, second case this week

NEW YORK (Reuters) - The U.S. government on Friday announced its second civil fraud lawsuit against Novartis AG in four days, accusing a unit of the Swiss drugmaker of paying multimillion-dollar kickbacks to doctors in exchange for prescribing its drugs. Authorities said the Basel-based company for a decade lavished healthy speaking fees and "opulent" meals, including a nearly $10,000 dinner for three at the Japanese restaurant, Nobu, to induce doctors to prescribe its drugs.

Chevron profit pinched by cheaper oil, but beats estimates

NEW YORK (Reuters) - The U.S. dollar tumbled against the yen on Friday after the Bank of Japan left its monetary policy unchanged, while benchmark U.S. bond yields fell to near 4-1/2-month lows after the U.S. economy grew less than expected in the first quarter. Suitey Is A Software Powered Real Estate Brokerage For New York City Apartments And Homes

suiteyAt first sight, Suitey looks like nothing more than a run-of-the-mill real estate website. But while sites like Trulia and Zillow merely provide a listing of available properties from a large assortment of brokerages and owners, all the properties on Suitey are being directly offered by Suitey itself. That?s because Suitey is a fully fledged real estate brokerage, and they believe they?re the first software-powered brokerage that offers a better, more transparent home buying experience. At their core, Trulia and Zillow are really nothing more than virtualized billboards. They provide a centralized location for brokers and owners to advertise their for-sale properties. Let?s say you?re looking for a new apartment, and you?ve narrowed down your list to five places. That means you?ll probably have to deal with five different real estate brokers, which from experience can be a total nightmare. With Suitey, everything is simplified. Once again, let?s say you?re looking for an apartment in Manhattan (for now, Suitey only offers listings in New York City). Once you narrow things down to five options on their website, you can contact a Suitey agent who will set a time to view all the properties with you. In the future, you?ll be able to video chat with the agent directly from the website. This face-to-face experience with Suitey?s agents is key to the company’s ethos. ?We want to ensure that our agents are people you?d feel comfortable buying a home from,? says David Walker, CEO of Suitey. He tells me that Suitey?s agents are heavily vetted by the company before they are hired in a process that ensures their competence and general likability. Once you?ve agreed to buy the home, Suitey gives you a one percent discount to sweeten the deal. That may not seem like much, but if you?re buying property for several million dollars, that rebate ends up being a couple thousand dollars you can put towards your deposit. ?I?ve never heard of anything quite like it, and it would interesting to see what happens,? says Laura Goldstein, Managing Editor of AOL Real Estate. ?People have such a bad association with real estate agents, and the customer service approach feels very appealing.? Suitey was one of the ten companies featured at the Entrepreneur Roundtable Accelerator?s Demo Day today. You can check out a roundup of startups from our coverage of the event here.

Ancient DNA reveals Europe's dynamic genetic history

Wednesday, April 24, 2013

Ancient DNA recovered from a series of skeletons in central Germany up to 7500 years old has been used to reconstruct the first detailed genetic history of modern Europe.

The study, published today in Nature Communications, reveals a dramatic series of events including major migrations from both Western Europe and Eurasia, and signs of an unexplained genetic turnover about 4000-5000 years ago.

The research was performed at the University of Adelaide's Australian Centre for Ancient DNA (ACAD). Researchers used DNA extracted from bone and teeth samples from prehistoric human skeletons to sequence a group of maternal genetic lineages that are now carried by up to 45% of Europeans.

The international team also included the University of Mainz in Germany and the National Geographic Society's Genographic Project.

"This is the first high-resolution genetic record of these lineages through time, and it is fascinating that we can directly observe both human DNA evolving in 'real-time', and the dramatic population changes that have taken place in Europe," says joint lead author Dr Wolfgang Haak of ACAD.

"We can follow over 4000 years of prehistory, from the earliest farmers through the early Bronze Age to modern times."

"The record of this maternally inherited genetic group, called Haplogroup H, shows that the first farmers in Central Europe resulted from a wholesale cultural and genetic input via migration, beginning in Turkey and the Near East where farming originated and arriving in Germany around 7500 years ago," says joint lead author Dr Paul Brotherton, formerly at ACAD and now at the University of Huddersfield, UK.

ACAD Director Professor Alan Cooper says: "What is intriguing is that the genetic markers of this first pan-European culture, which was clearly very successful, were then suddenly replaced around 4500 years ago, and we don't know why. Something major happened, and the hunt is now on to find out what that was."

The team developed new advances in molecular biology to sequence entire mitochondrial genomes from the ancient skeletons. This is the first ancient population study using a large number of mitochondrial genomes.

"We have established that the genetic foundations for modern Europe were only established in the Mid-Neolithic, after this major genetic transition around 4000 years ago," says Dr Haak. "This genetic diversity was then modified further by a series of incoming and expanding cultures from Iberia and Eastern Europe through the Late Neolithic."

"The expansion of the Bell Beaker culture (named after their pots) appears to have been a key event, emerging in Iberia around 2800 BC and arriving in Germany several centuries later," says Dr Brotherton. "This is a very interesting group as they have been linked to the expansion of Celtic languages along the Atlantic coast and into central Europe."

"These well-dated ancient genetic sequences provide a unique opportunity to investigate the demographic history of Europe," says Professor Cooper.

"We can not only estimate population sizes but also accurately determine the evolutionary rate of the sequences, providing a far more accurate timescale of significant events in recent human evolution."

The team has been working closely on the genetic prehistory of Europeans for the past 7-8 years.

Professor Kurt Alt (University of Mainz) says: "This work shows the power of archaeology and ancient DNA working together to reconstruct human evolutionary history through time. We are currently expanding this approach to other transects across Europe."

Genographic Project director Spencer Wells says: "Studies such as this on ancient remains serve as a valuable adjunct to the work we are doing with modern populations in the Genographic Project. While the DNA of people alive today can reveal the end result of their ancestors' ancient movements, to really understand the dynamics of how modern genetic patterns were created we need to study ancient material as well."

The Hero Eco A2B Metro Electric Bike Is A City Commuter's Dreamcycle

As a man who spends most of his time in his attic, it's nice to hit the open roads, feel a little wind in your hair, and run over crack vials as you motor through downtown Manhattan. That's exactly what I did yesterday as when I tried to ride an Ultra Motors A2B Metro electric bike from Bay Ridge to our offices on Broadway, thereby cementing my love for electric bikes and this electric bike in particular.

Game of Thrones, Season 3

Westeros is a funny place. With its kings and queens and lords and ladies, it?s the opposite of egalitarian. But it?s also a place where women and smugglers can be knighted, where having a famous name can lead to a lifetime of exile, and where pimps and eunuchs can end up advising kings. Cunning Varys, who has risen to great influence in mysterious fashion, demonstrated his skills this week, and made it clear that Westeros offers multiple paths to power-seekers.

First, he shares with Tyrion with the traumatic story of how he was castrated and then thrown out to the streets to die. ?Influence is largely a matter of patience,? he says. ?Step by step, one distasteful task after another, I made my way from the slums of Myr to the small chamber.? This scene is important not only because it gives the viewer insight into Varys, but also because it sets the tone for the rest of the episode: Vengeance is on the minds of many in Westeros, though not everyone is as patient as Varys.

Varys It's a treat to watch Lord Varys pull the levers of powers behind the scenes, as he does here in a conversation with Lady Olenna Redwyne

Next we see Varys at work as the Master of Whispers. He and Ros are gossiping about the sexual prowess of Pod, Tyrion?s squire, when he tells her that ?prodigies appear in the oddest of places.? This is, of course, a largely nonsexual double entendre, as Ros herself started out as one of Littlefinger?s prostitutes but is now his trusted assistant and adviser.

And lastly, we see Varys doing what he does best?using the intelligence he has procured from Ros to serve the realm, at least as he sees it. Having learned that Littlefinger intends to take Sansa Stark?the ?key to the north? and the Lannisters? hostage?on his voyage to propose to her aunt, Varys turns to Lady Olenna Redwynne, matriarch of the Tyrells. And whaddya know: All of a sudden Margaery Tyrell suggests to Sansa that it would be lovely for her to marry Loras so they could be sisters.

No doubt that some will complain that these scenes are a departure from the events of Storm of Swords, on which the season is based. Over at the AV Club, Todd VanDerWerff (a frequent guest of Slate?s "TV Club") addresses the need for the show to depart from the source material at times. He?s mostly talking about the way the show has handled Barristan Selmy and Daenerys? knowledge of Valyrian. I would argue that the same point applies to Varys.

He?s an important figure in Westeros, but because he so often lurks in the shadows, we know of his exploits and power only from what other people say about him, and how wary of him they are. That is fine for a book, but on a television show, it?s far more entertaining for us to see at least few scenes showing a smooth operator at work than it is to listen to characters cursing him and his spiders.? And while we don?t yet know all the ?distasteful tasks? that he completed on his journey to the small council, we are now privy to at least a few of his secrets.?

Use your personal smartphone for work email? Your company might take it

By Bob Sullivan, Columnist, NBC News

If you use your personal smartphone or tablet to read work email, your company may have to seize the device some day, and you may not get it back for months.

Employees armed with a battery of smartphones and other gadgets they own are casually connecting to work email and other employer servers. It's a less-than-ideal security arrangement that technology pros call BYOD?? bring your own device.

Now, lawyers are warning there's an unforeseen consequence of BYOD. If a company is involved in litigation???civil or criminal???personal cellphones that were used for work email or other company activity are liable to be confiscated and examined for evidence during discovery or investigation.

It's a possibility even technology pros rarely consider, said Michael R. Overly, a technology law expert in Los Angeles.

"You would be very surprised to hear that even extremely sophisticated business people seem shocked when they learn their personal phone, including email, GPS data, photos ... may be subject to review in litigation involving their employer," Overly said.

BYOD is a worldwide reality and a dramatic shift in the way companies outfit their employees with work tools. Cisco Systems Inc. released a report earlier this year saying 42 percent of all "knowledge workers" own the smartphones they use for work, and two-thirds of companies expect the employee-owned device phenomenon to increase.

Hidden cost
The convenience is hard to ignore, as is the personal touch ? workers love picking their own phones???but of course, cost savings is the real driving force. Increasingly, companies are requiring workers to supply their own gadgets at their own cost, the way a restaurant might require waiters to purchase their own uniforms.

Even if companies reimburse those employees, there can be a big hidden cost for workers???the possibility of losing their phone for days or months while their company combs through it for data relevant to legal action.

?People?s lives revolve around their phone, and they are going to become more and more of a target in litigation,? Overly said. ?Employees really do need to understand that .?

Giri Sreenivas, a mobile phone security expert at Boston-area firm Rapid7, warned discovery requirements can extend far beyond email stored on smartphones.

"Text messages and cellphone records might be subject to discovery, too, even if you never connected to company email," he said.? "If lawyers believe the device was used for work purposes, it can be (taken).?

Race to keep up
How could firms gain the right to rummage through the most personal items on worker?s phones???pictures, texts, social media accounts?? In many cases, it?s not a right, it?s a duty, says Overly. When a company is sued, and required to produce documents as part of a discovery process, it must make a good-faith effort to retrieve data???wherever it may be. That includes employee-owned gadgets.?

In fact, Overly says he was part of a case recently where a judge sanctioned a company for a discovery violation because it failed to search BYOD devices during discovery. He declined to name the case.

Companies are racing to keep up with the trend???trying to set policies, inform workers of their rights, and superimpose BYOD rules over arrangements that organically evolved within their workplaces. Increasingly, companies are requiring workers to sign agreements that alert them to the potential of personal gadget seizure, Overly said.

Christopher Dahl runs a Seattle-based firm that specializes in digital document retrieval for lawyers called Lighthouse eDiscovery. While he says industry discussion is dominated by talk of BYOD discovery, he said gadget seizure has not become common???yet.

"We see mobile devices infrequently. We only had one come in last month," Dahl said. "It's typically pretty rare where the company can't get the same information from another location. Companies will have to disclose that the information is on that second location (the smartphone) but typically don't have to dig into that second place." ?

Red Tape wrestling tips
Workers wary of having their personal phone nabbed can carry two phones ? one personal and one for work ? but even that?s not fool-proof. An occasional connection from the personal phone to work email can make the phone subject to discovery. Going this route requires diligent work and personal separation.

"The No. 1 thing you can do to ensure your device is not subject to seizure is to remove any sort of company account ... and then inform the company it's been removed," said Sreenivas.

Dahl warned about accidental blending of personal and work data through a seemingly innocent USB charge connection that leads to accidental synching of data.?

There may be a technology solution to this problem in the future. The newest Blackberry phone claims to create a work data-personal data divide, which has the potential to limit the searches that might be conducted by company lawyers

ITHACA, N.Y. A research team led by Cornell University's Creative Machines Lab has created a computer algorithm that can be used to witness virtual creatures evolving their squishy, muscle-like features in order to teach themselves to walk.

The team incorporated concepts from developmental biology and how nature builds complex animals from jellyfish to jaguars. The result is an array of bizarre, simulated robots that evolve a diverse series of gaits and gallops.

The paper describing these soft-bodied robots will appear in Proceedings of the Genetic and Evolutionary Computation Conference and is titled "Unshackling Evolution: Evolving Soft Robots With Multiple Materials and a Powerful Generative Encoding."

Download the paper: http://jeffclune.com/publications/2013_Softbots_GECCO.pdf

See the video: http://youtu.be/z9ptOeByLA4

Lead author Nick Cheney, a Cornell graduate student, will present the paper at the July conference in Amsterdam. Robert MacCurdy, also a graduate student at Cornell, contributed to the work, as well as Jeff Clune, assistant professor at the University of Wyoming and former visiting scientist at Cornell.

The video shows evolution in action: A creature evolves into a galloping, soft robot over 1,000 generations. While 1,000 generations is relatively short by natural evolution standards, it is enough to demonstrate the power of evolution to create counterintuitive designs, according to the researchers.

In the paper, they describe how they challenged human engineers to design robots made of these soft and hard materials. The human efforts paled in comparison to the designs resulting from evolution.

###

More than a decade ago, Cornell professor Hod Lipson led a project called Golem that similarly evolved robots, and he later built them with a 3-D printer. That video and others from the Creative Machines Lab can be viewed at http://creativemachines.cornell.edu/videos.

The research was supported by the National Science Foundation and the Defense Advanced Research Projects Agency.
